Missouri doesn’t directly address surrogacy arrangements; however, there is a potential they are currently violating the state’s laws on child trafficking. The surrogacy issue dealing with LGBT couples hasn’t been looked at by the courts yet.


Trafficking children is a felony in Missouri, and it encompasses payment for delivery of a children, for adoption purposes, or for the consent of adoption or waiver of consent for a future adoption or to relinquish parental rights completely. A surrogacy contract that’s compensated could run afoul of this law.
