Surrogacy Laws in Virginia

Virginia clearly allows for surrogacy that’s not compensated, but it seems to disallow same-sex couples from participating in these contracts.

Explanation: Virginia laws impose several sanctions on surrogacy contracts, including restricting the formation of these agreements to a surrogate and “intended parents” being defined as a “woman and a man, married to each other.” Furthermore, the law would need a circuit court order to approve the agreement.
