Surrogacy Laws in Washington D.C.

All surrogacy arrangements, no matter what the sexual orientation of the persons involved, are disallowed in the District of Columbia.

Explanation: Under current laws on the books in D.C., both gestational and traditional surrogacy are disallowed and not enforceable. Anyone who violates the statute is punished with a fine that can go all the way up to $10,000, and jail time might go up to a year.
