West Virginia doesn’t have any laws that directly address surrogacy contracts’ legality. Surrogacy agreements involving LGBT individuals and couples haven’t yet been looked at by the courts.

Explanation: State law having to do with the sale or purchase of a child clearly mentions that expenses and fees with any agreement where a woman consents to becoming a surrogate mother aren’t prohibited by the law.
